DMCA Copyright Infringement Policy

ProVideoTours, LLC ("ProVideoTours," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), Title 17, United States Code, Section 512, we will respond expeditiously to claims of copyright infringement committed using the ProVideoTours website or desktop application (collectively, the "Service") if reported to our Designated Copyright Agent identified below.

1. Notice of Copyright Infringement (Takedown Notice)

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Service by completing a DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent. Upon receipt of a valid Notice, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged material from the Service.

To be legally effective, your DMCA Takedown Notice must include the following information:

1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of the Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
3. Identification of the Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (such as the specific URL link or account details).
4. Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
5. Statement of Good Faith: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. Statement of Accuracy under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Our Designated Copyright Agent

Please deliver all DMCA Takedown Notices to ProVideoTours, LLC's Designated Agent at the following address:

⚠️ Note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including legal fees and court costs incurred by us or the alleged infringer.

3. Counter-Notification Procedures

If you believe that material you uploaded or imported was removed (or access was disabled) by mistake or misidentification, you may file a Counter-Notification with us by sending a written communication to our Designated Agent listed above. To be valid, a Counter-Notification must include substantially the following:

• Your physical or electronic signature;
• Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, that you consent to the jurisdiction of the Federal District Court for the Middle District of Florida, located in Tampa/St. Petersburg), and that you will accept service of process from the person who provided the original infringement notification.

Upon receipt of a valid Counter-Notification, we will promptly forward a copy to the original complaining party. If the copyright owner does not file a lawsuit seeking a court order against you within 10 to 14 business days, we are legally permitted to replace or restore access to the removed material.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, ProVideoTours, LLC maintains a strict policy of terminating, in appropriate circumstances and at our sole discretion, the accounts and activation keys of users who are deemed to be repeat infringers.
